LocaleIQ Corporation ("LocaleIQ", "we", "us", or "our") is committed to protecting your privacy. Please read our privacy policy carefully. By visiting the www.localeiq.com website (the “Site”), submitting information or accessing and using the hosted information management solution, web site, LocaleIQ™ portal, modules, and APIs, products, and/or applications and services (collectively the “Service(s)”), or using the Services to create and publish online content, images, videos, geographic information, surveys, goods and services, or other content (collectively, "Content"), or creating an account with LocaleIQ to use the Services (becoming a “Registered User”), you acknowledge that you accept the practices and policies outlined in this Privacy Policy for you and your business or government entity.


Changes to this Privacy Policy

LocaleIQ may from time to time update this Privacy Policy. Any changes to this Privacy Policy will become effective when we post or link to the revised Privacy Policy on the Site. Please review the “Last updated” legend at the top of this page to determine when this Privacy Policy was most recently revised. You agree to review this Privacy Policy periodically to ensure that you are aware of any changes. Your continued access or use of the Site and/or the LocaleIQ Service shall be deemed your conclusive acceptance of any amendments and/or modifications.


What is Covered in This Privacy Policy?

This Privacy Policy explains how we collect your personal data on the Site and how we protect such data, and the choices you have concerning our use of such data. Please read this Privacy Policy carefully.


This Privacy Policy covers LocaleIQ's treatment of personally identifiable information (collectively with “Submitted Information” (as defined herein), the "Personal Information") that LocaleIQ gathers when you are accessing the Site and when you use the Service or become a Registered User. Furthermore, this Privacy Policy covers LocaleIQ's treatment of any Personal Information that LocaleIQ's business partners share with us. This Privacy Policy does not apply to the practices of companies that LocaleIQ does not own or control, or to individuals that we do not employ or manage.


Types of Data Collected

We may gather three basic types of information: Personal Data, Monitoring Data and IP Addresses.


Collection of Personal Data

Personal data is information that identifies you or can be used to identify or contact you, e.g., your name, email address, user name, address, phone number, or any other personal information that would allow LocaleIQ to identify you or contact you if needed (“Personal Data”). LocaleIQ may request Personal Data from you when you register on the Site or at any point thereafter via the LocaleIQ portal in the course of doing business with you. In addition to information collected during registration, we may ask you to provide certain other information such as general demographic information, ZIP code, preferences, and job title. The information we gather from our users enables us to manage our business with you and to personalize and improve the LocaleIQ Service.


We may receive and store any information you enter on the Site or provide to us in any other way. The Personal Information you provide may be used for providing attribution to content, multimedia, data you create or upload, edits you make, within your private LocaleIQ account and attribution to publically posted Content based on your account name, to operate and improve the Site, and to better deliver the LocaleIQ Service.


Safeguard your username and password carefully and do not disclose it to any other person


We use a third-party payment service ( a “Payment Service”) to collect payments made through the Site. If you make a payment through the Site, any Personal Data that you provide through the Payment Service will be collected by Payment Service as well as by LocaleIQ; we note that any such collection and subsequent use of Personal Data by Payment Service will be subject to Payment Service’s privacy policy, while our collection and use of such Personal Data will be subject to this Privacy Policy. We do not collect or store any credit card or payment information; such payment information is captured by the Payment Service only. LocaleIQ has no control over, and shall not be responsible for, Payment Service's use of information collected through the Payment Service Page. PLEASE NOTE THAT THIS PRIVACY POLICY DOES NOT ADDRESS THE COLLECTION AND USE OF INFORMATION BY PAYMENT SERVICE THROUGH THE PAYMENT SERVICE PAGE OR THE PRIVACY OR INFORMATION PRACTICES OF PAYMENT SERVICE.


You do not have to provide us with any Personal Data to visit the Site. However, if you choose to withhold requested information, you will not be able to visit all sections or use all features of the Site.


Collection of Monitoring Data and Use of Certain Online Tools

In addition to Personal Data, LocaleIQ and its service providers may collect, track and store information whenever you interact with the Site and LocaleIQ Services that by itself cannot be used to identify or contact you, e.g., demographic information, domain names, computer type, browser types, screen resolution, the page you requested and other anonymous statistical data involving the use of the Site (“Monitoring Data”).


Unless combined with Personal Data, Monitoring Data does not personally identify you or any other user. Additionally, we may aggregate Personal Data in a manner such that the end-product does not personally identify you or any other user of the Site, for example, by using information to calculate the percentage of our users who use a specific type of device to access the Services. Such aggregate information is considered Monitoring Data for purposes of this Privacy Policy.


To enhance the Internet experience on the Site, LocaleIQ and our service providers may use ‘cookies’ on the Site. Cookies are data that a web server transfers to an individual’s computer for recordkeeping and other purposes. We use cookies and other technologies to facilitate users’ ongoing access to and use of our Site. If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies, or to be given the choice of declining or accepting the transfer of a particular cookie, or cookies from a particular web site, to your computer. If cookies are disabled, however, all features of the Site may not operate as intended. We and our service providers may also use various common Internet tools such as ‘pixel tags,’ ‘action tags,’ ‘web beacons,’ ‘.gif tags,’ ‘JavaScript’ or similar technologies (together, “Tools”) in connection with Site pages and email messages in certain formats to among other things, track the actions of Site users and email recipients, to compile statistics about Site usage and response rates. Tools allow us to count users who have visited certain pages of the Sites, to deliver branded services, and to help determine the effectiveness of promotional or advertising campaigns. When used in email messages in certain formats, Tools can tell the sender whether and when the email has been opened.


LocaleIQ uses these technologies to understand how the Site is used and to customize and enhance the Internet experience of individual users. When you revisit the Site, LocaleIQ__________ may recognize you by a Tool and customize your experience accordingly. For example, once you have completed the registration process, a cookie and/or Tool will be used to avoid having you register again. We believe cookies and Tool technologies add value to the user experience, and the information resulting from these technologies is not sold or otherwise made available by LocaleIQ to third parties for such third parties’ marketing purposes. We similarly expect our service providers to do the same.


Collection of IP Addresses

When you visit and interact with the Site, we and third parties with whom we have contracted to provide services to us may collect IP Addresses. Your Internet Protocol (IP) address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). This number is identified and logged automatically in our server log files whenever you visit the Sites, along with the time(s) of your visit(s) and the page(s) that you visited. Where required by applicable law, this log information may be treated as Personal Data.


Information to Social Networking Websites

The LocaleIQ Services allow you to share Content with third party social networking websites (collectively, the “Social Networks”), such as Twitter, Facebook and LinkedIn. You have full control of the user and/or account name and Content that you share with these sites when passing information from the LocaleIQ Services to these Social Networks; LocaleIQ does not share any information with the Social Media Networks and is not responsible for the information you share.


Use of Data Collected

Use of Personal Data Collected

Fulfillment of Requests. LocaleIQ may use Personal Data about you to fulfill the purpose for which such Personal Data was provided (e.g., to send newsletters to you or to deliver products and services). You may opt-out of receiving such communications at any time by clicking the “unsubscribe” option or by notifying unsubscribe@localeiq.com.


Other Communications. From time to time, we may use Personal Data about you to inform you of products, programs, services and promotions that we believe may be of interest to you. You may opt-out of receiving such communications at any time by clicking the “unsubscribe” option or by notifying unsubscribe@localeiq.com. However, after you unsubscribe to cease receiving e-mails, LocaleIQ may still contact you via e-mail for administrative or informational purposes, including messages regarding the administration of your account and/or any services or events to which you have registered.


Internal Business Purposes. We may also use Personal Data about you for our internal business purposes, such as data analysis, editorial and feedback purposes, providing customer support, customizing and improving the content and layout of the Site or other web sites, completing business transactions, marketing & promotion, statistical analysis of user behavior, product development, administering individual accounts, and meeting government regulatory requirements such as sales tax collection, audits and so forth.


LocaleIQ may occasionally hire other companies to provide limited administrative, sales, support and communication services on our behalf, such as hosting websites, the processing and delivery of mailings, providing customer support, or performing statistical analysis of the Services. Those companies will be permitted to obtain only such personal information as necessary for them to deliver the service. Those companies are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose. You hereby consent to our sharing of Personal Information for the above purposes.


Administrative Communications. In addition, LocaleIQ reserves the right to use Personal Data to send to you important information regarding the Site, your account status and changes to the Terms of Use, this Privacy Policy, or any other policies, agreements or transactions relevant to your use of the Site. Because this information may be important to your use of the Site, you may not opt-out of receiving such communications.


Assignment. We reserve the right to transfer any and all information that we collect to an affiliated entity or a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings). You acknowledge that such transfers may occur, and that any acquirer of LocaleIQ may continue to use your Personal Information as set forth in this Privacy Policy.


Syndication of Published Content. Pursuant to the license granted by you to LocaleIQ under the Terms of Service, which can be accessed at www.localeiq.com/termsofuse, LocaleIQ has the right to gather or distribute for publication (hereafter referred to as a right to “syndicate” or “syndication”) any Content you post publically and approve for syndication via the LocaleIQ Services, to our publishing partners who may republish your content, data, maps, ideas, information, multimedia or links on their site or via their publishing network. Syndication is LocaleIQ’s primary way of making sure that your publically shared Content gets seen by as many potential customers, visitors, online viewers and partners as possible. You hereby consent to LocaleIQ’s syndication and republication by publishing partners of such content by LocaleIQ to third parties, including the use and disclosure by LocaleIQ and any third party of your personal or account information, depending on how you label the published materials, for purposes of attributing such content to you.


Law enforcement; emergencies; compliance. Notwithstanding any other provision of this Privacy Policy to the contrary, we reserve the right to disclose Personal Data about you to others as we believe to be appropriate (a) under applicable law; (b) to comply with legal process; (c) to respond to governmental requests; (d) to enforce our Terms of Service; (e) to protect our operations or those of any affiliated entities; (f) to protect the rights, privacy, safety or property of LocaleIQ, its employees, the affiliated entities, members of the public, you or others; and (g) to permit us to pursue available remedies or limit the damages that we may sustain. For example, we may, to the fullest extent the law allows, disclose Personal Data about you to law enforcement agencies to assist them in identifying individuals who have been or may be engaged in unlawful activities.


Use of Monitoring Data Collected

Monitoring Data may be used for internal or external purposes such as researching and identifying market segments and needs. Because Monitoring Data does not personally identify you, we may use such information for any purpose. In addition, we reserve the right to share Monitoring Data with affiliated entities and other third parties, for any purpose.


In some instances, we may combine Monitoring Data with Personal Data (such as combining your name with your geographic location). If we do combine Monitoring Data with Personal Data, the combined information will be treated by us as Personal Data as long as it is so combined.


Security and Protection of Personal Information

We maintain reasonable standards of security and confidentiality and store Personal Information collected in a database. However, while we employ reasonable standards of security, no security system is impenetrable. For most internet sites, it is possible that third parties may unlawfully intercept or access transmissions you submit. As such, LocaleIQ cannot guarantee the security of our database, nor can we guarantee that information you supply won’t be intercepted while being transmitted to LocaleIQ over the internet. We recommend that you do not disclose your user name or password to anyone


Retention Period

We will retain Personal Data about you for the period reasonably necessary to fulfill the purposes outlined in this Policy and consistent with retention periods required by law and/or regulation.


Enforcement

LocaleIQ periodically will review its compliance with this Privacy Policy. LocaleIQ will also review and respond to any formal written complaints that we receive from you. LocaleIQ will cooperate with the appropriate regulatory authorities, to resolve any complaints that cannot be resolved between us.


Children’s Online Privacy Protection

The safety of children is important to us. The Site is a general audience site and is not directed to children under the age of 13. Similarly, services available on or through the Site are not directed to nor intended for anyone under the age of 13. We will not knowingly accept, collect or maintain Personal Data from or about anyone under the age of 13.
